Understanding these figures

The role of an administrative tribunal

The administrative tribunal is the ordinary court, at first instance, for disputes between a public body and an individual, a company or an association: a decision by a prefect, a municipality or a hospital, a refused residence permit, a building permit, a tax, a sanction against a public servant… Each tribunal covers a geographic area. As a rule, its judgment can be challenged on appeal before an administrative court of appeal; some judgments can only be challenged in cassation before the Conseil d'État.

Judgments and orders

The decisions counted here are judgments and orders. A judgment settles the case after investigation, most often following a public hearing. An order is issued by a single judge, either in summary proceedings (an urgent procedure that can, for instance, suspend an administrative decision pending judgment) or to close an application without a hearing when it is clearly inadmissible or the applicant has withdrawn. Orders count in the volumes, but not in the time to judgment.

Reading the median time

Time is counted from the filing of the application to the judgment. The median splits the cases into two halves: one is decided faster, the other more slowly. It is preferred to the average, which a small number of very long cases is enough to inflate. The quartiles give the range: a quarter of the cases are decided before the first quartile, a quarter after the third. The calculation covers judgments, excluding orders.

Reading the dismissal rate

The dismissal rate relates dismissals to all decisions with a stated and classified outcome. Dismissal covers claims found unfounded, inadmissible or brought before the wrong court. Withdrawals and “no need to rule” decisions end the case without a ruling on the merits: they are not dismissals and are shown separately.

The figures of this tribunal

Before the Tribunal administratif de Nouvelle-Calédonie, civil service accounts for 6% of the decisions of 2025, against 4% for all administrative tribunals; policing accounts for 6% (1% for all administrative tribunals). The dismissal rate and the median time vary from one subject to another: the Tribunal administratif de Nouvelle-Calédonie and another tribunal cannot be compared point by point without taking into account the cases brought before them. No statistic can predict the outcome of a particular case.
